Acceptance of Terms
By accessing and using ItemFits ('the Service'), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
These Terms of Service constitute a legal agreement between you and ItemFits regarding your use of our dimension calculation and 3D visualization services.
Use of Service
ItemFits checks whether large items will fit through doors, up stairs, in elevators, in vehicles, and around hallway corners, and produces 3D visual proofs of that decision. You may use the service to:
• Run fit checks against your dimensions or ours
• Generate 3D visual proofs of fit decisions
• Save items and spaces to re-use on later checks
• Use the AI assistant to describe your item and space in plain language
By using the service, you acknowledge that:
• Chat messages and fit-check inputs are stored on your account so you can review them later and so we can investigate bugs and abuse
• Aggregate usage patterns help us improve solver accuracy and surface defaults
• You can delete your account and erase your stored data at any time from Settings → Account → Danger zone
You agree to use the service only for lawful purposes and in accordance with these Terms of Service.
Account Responsibilities
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:
• Safeguarding the password and maintaining account security
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your contact information remains up to date
You may not share your account credentials or allow others to access your account.
Accuracy and Limitations
While we strive for accuracy, ItemFits calculations and visualizations are estimates for planning purposes only. You understand that:
• Measurements may have margins of error
• 3D visualizations are approximations
• Real-world factors may affect actual fit
• Professional consultation may be needed for critical applications
You should verify all measurements independently before making purchase or installation decisions.
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of ItemFits and its licensors. The service is protected by copyright, trademark, and other laws.
You retain ownership of any content you upload. You grant us a limited license to store and process that content for the purpose of running the service for you — generating fit checks and visual proofs, saving them to your account, and supporting your use of the product. We do not claim a perpetual or irrevocable right to your content; if you delete your account, your identifying records are erased and any retained content is anonymized as described in our Privacy Policy.
You may not copy, modify, or distribute our software or content without permission.
User Content and Conduct
You are solely responsible for any content you upload or submit, including chat messages and dimensions you enter. By using the service, you grant us permission to:
• Store your fit-check inputs and chat messages on your account so you can return to them
• Use aggregate usage patterns to improve solver accuracy and product defaults
• Retain anonymized records (with your identity stripped) after account deletion, where useful for product quality and abuse prevention
You agree not to:
• Upload illegal, harmful, or offensive content
• Violate any third party's intellectual property rights
• Interfere with or disrupt the service
• Attempt to gain unauthorized access to our systems
• Use the service for commercial purposes without an appropriate plan or partnership
We reserve the right to remove any content or suspend accounts that violate these terms.
Payments and Packs
ItemFits is sold as one-time fit-check packs — there are no subscriptions and no auto-renewals. By purchasing a pack, you agree to:
• Pay the listed price in USD at checkout, processed by Stripe
• Receive the fit checks and visual proofs in that pack as a non-expiring balance on your account
• Accept that digital balances are non-refundable once delivered, except where required by law (see below)
• Receive at least 30 days advance notice of any change to listed pack prices
If a charge is unsuccessful or you believe a pack was credited in error, contact us at roscatoday@gmail.com and we will investigate. You can purchase additional packs at any time; balances from multiple purchases stack together.
Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
We shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the service. Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless ItemFits and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
• Your use of the service
• Your violation of these terms
• Your violation of any third party rights
• Any content you submit to the service
Termination
We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including breach of these Terms.
Upon termination, your right to use the service will cease immediately. You may terminate your account at any time by contacting us at roscatoday@gmail.com.
Governing Law and Disputes
These Terms shall be interpreted and governed by the laws of the jurisdiction where ItemFits operates, without regard to conflict of law provisions.
Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration, except that each party retains the right to seek injunctive relief in court.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
Your continued use of the service after any changes constitutes acceptance of the new Terms of Service.
