Acceptance of Terms
ItemFits LLC ("ItemFits," "we," "us," or "our") operates and provides the ItemFits service and is the party entering into these Terms with you.
By accessing and using ItemFits ('the Service'), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
These Terms of Service constitute a legal agreement between you and ItemFits LLC regarding your use of our dimension calculation and 3D visualization services.
Use of Service
ItemFits checks whether large items will fit through doors, up stairs, in elevators, in vehicles, and around hallway corners, and produces 3D visual proofs of that decision. You may use the service to:
• Run fit checks against your dimensions or ours
• Generate 3D visual proofs of fit decisions
• Save items and spaces to re-use on later checks
• Use the AI assistant to describe your item and space in plain language
By using the service, you acknowledge that:
• Chat messages and fit-check inputs are stored on your account so you can review them later and so we can investigate bugs and abuse
• Aggregate usage patterns help us improve solver accuracy and surface defaults
• You can delete your account and erase your stored data at any time from Settings → Account → Danger zone
You agree to use the service only for lawful purposes and in accordance with these Terms of Service.
Account Responsibilities
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:
• Safeguarding the password and maintaining account security
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your contact information remains up to date
You may not share your account credentials or allow others to access your account.
Accuracy and Limitations
While we strive for accuracy, ItemFits calculations and visualizations are estimates for planning purposes only. You understand that:
• Measurements may have margins of error
• 3D visualizations are approximations
• Real-world factors may affect actual fit
• Professional consultation may be needed for critical applications
You should verify all measurements independently before making purchase or installation decisions.
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of ItemFits LLC and its licensors. The service is protected by copyright, trademark, and other laws.
You retain ownership of any content you upload. You grant us a limited license to store and process that content for the purpose of running the service for you — generating fit checks and visual proofs, saving them to your account, and supporting your use of the product. We do not claim a perpetual or irrevocable right to your content; if you delete your account, your identifying records are erased and any retained content is anonymized as described in our Privacy Policy.
You may not copy, modify, or distribute our software or content without permission.

User Content and Conduct
You are solely responsible for any content you upload or submit, including chat messages and dimensions you enter. By using the service, you grant us permission to:
• Store your fit-check inputs and chat messages on your account so you can return to them
• Use aggregate usage patterns to improve solver accuracy and product defaults
• Retain anonymized records (with your identity stripped) after account deletion, where useful for product quality and abuse prevention
You agree not to:
• Upload illegal, harmful, or offensive content
• Violate any third party's intellectual property rights
• Interfere with or disrupt the service
• Attempt to gain unauthorized access to our systems
• Use the service for commercial purposes without an appropriate plan or partnership
We reserve the right to remove any content or suspend accounts that violate these terms.
Payments and Packs
ItemFits is sold as one-time fit-check packs — there are no subscriptions and no auto-renewals. By purchasing a pack, you agree to:
• Pay the listed price in USD at checkout, processed by Stripe
• Receive the fit checks and visual proofs in that pack as a non-expiring balance on your account
• Accept that digital balances are non-refundable once delivered, except where required by law (see below)
• Receive at least 30 days advance notice of any change to listed pack prices
If a charge is unsuccessful or you believe a pack was credited in error, contact us at support@itemfits.com and we will investigate. You can purchase additional packs at any time; balances from multiple purchases stack together.
Individual Use — Unlimited Access
The Unlimited access pack is intended for individual, personal use. Your purchased balance is for your own fit-check queries and is non-transferable.
Excessive automated, programmatic, bulk, resale, or commercial usage — including but not limited to scripted queries, API harvesting, reselling results, or integrating the service into a third-party product or workflow — is not permitted under an individual pack and may require a separate business license.
If you intend to use ItemFits in a commercial, agency, or high-volume context, contact us at support@itemfits.com to discuss a business arrangement. We reserve the right to suspend or rate-limit accounts that exceed reasonable individual-use patterns without a business license.
Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, ITEMFITS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.
ItemFits LLC shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the service. ItemFits LLC’s total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless ItemFits LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
• Your use of the service
• Your violation of these terms
• Your violation of any third party rights
• Any content you submit to the service
Termination
We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including breach of these Terms.
Upon termination, your right to use the service will cease immediately. You may terminate your account at any time by contacting us at support@itemfits.com.
Governing Law and Disputes
These Terms shall be interpreted and governed by the laws of the jurisdiction where ItemFits LLC operates, without regard to conflict of law provisions.
Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration, except that each party retains the right to seek injunctive relief in court.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
Your continued use of the service after any changes constitutes acceptance of the new Terms of Service.

Shopify Merchant Data Processing Terms
Scope. These terms are between ItemFits LLC (“ItemFits,” “we,” “us,” or “our”) and the merchant accepting them. ItemFits LLC provides the ItemFits Shopify service, including merchant-branded and white-label experiences. Business contact: ItemFits LLC, 401 East Jackson Street, Suite 2340, Tampa, FL 33602, United States; support@itemfits.com. These terms supplement the ItemFits Terms of Service for Shopify merchants. They govern ItemFits' processing of Shopify shopper personal data on the merchant's behalf and take precedence over conflicting general provisions about reuse of user content or anonymized data. “Personal data” includes linkable customer, visitor, session, and order identifiers, not only names or contact fields.
Roles and instructions. The merchant determines the purposes and lawful basis of its store's shopper-data processing and acts as controller or business where applicable. ItemFits acts as processor or service provider for the fit-check, conversation, catalog-related shopper context, and merchant-reporting processing described in the Shopify section of the Privacy Policy. ItemFits acts independently, as a controller in its own right rather than on the merchant's instructions, for its own merchant subscription administration, account and onboarding email sent to the merchant's business contact address, security, and legal obligations. That merchant business-contact processing is not shopper personal data and is not governed by these processor terms. The merchant's authorized use and configuration of the app, these terms, and verified support requests provide the processing instructions. Instructions outside the described services require agreement before implementation.
Subject matter and duration. Processing supports shopper fit questions, saved context, merchant analytics, troubleshooting, and eligible paid-order attribution where access is enabled. Data subjects are customers, prospective customers, and store visitors. Data categories include submitted dimensions and messages, fit results, activity/timestamps, product references, browser/session identifiers, verified customer bindings, permitted order details, and, where enabled, storefront commerce events recorded through a Shopify web pixel. Processing continues as required to provide the configured service and complete applicable return/deletion requests or legal retention. The Privacy Policy explains the current retention limitations; these terms do not create a shorter automatic deletion schedule that the service has not implemented.
Purpose limitation. ItemFits will process shopper data only to provide the documented services on the merchant's instructions, or where legally required. It will not sell shopper data, share it for targeted advertising, use identifiable Shopify shopper data to train models, or market to shoppers using it. Broader permissions elsewhere in the general terms do not authorize those uses. ItemFits will not use shopper data from different merchants to create advertising profiles.
Aggregated data. The merchant authorizes ItemFits to derive and retain aggregated, de-identified statistics from store data for the purposes described in the Shopify Privacy Policy section. ItemFits will not attempt to re-identify a shopper and will not disclose a store's individual figures to another merchant or third party. Naming the store, using its logo, or publishing its individual results requires the merchant's separate, revocable permission.
Merchant responsibilities and consent. The merchant is responsible for appropriate notices, a lawful basis, and obtaining consent where required. ItemFits is responsible for applying the controls it provides and following lawful, supported instructions. App installation, API authorization, and a merchant's cookie banner do not alone demonstrate shopper consent enforcement. The merchant must confirm that required choices and withdrawals can be implemented before enabling consent-dependent analytics. If required controls are unavailable, that processing must remain disabled or be suspended; neither party may treat these terms as a substitute for the controls.
Confidentiality and safeguards. ItemFits will restrict access to authorized personnel and service providers who need data for the documented purpose, maintain appropriate confidentiality obligations, and use safeguards appropriate to the processing. These include authenticated access, store-scoped access restrictions, signature validation, server-side service credentials, and protected public transport. ItemFits will notify the merchant without undue delay after becoming aware of a personal-data breach affecting its shopper data and provide available information and reasonable cooperation for the merchant's response obligations.
Service providers and transfers. The Shopify Privacy Policy section identifies the service providers and purposes. The merchant authorizes their use for those purposes subject to applicable processing and confidentiality terms. ItemFits remains responsible for its processor obligations and will provide information about relevant provider changes so the merchant can raise a reasonable data-protection objection before continuing affected processing. Where applicable law requires additional international-transfer terms or a specific data-processing agreement, the parties must put those arrangements in place before the affected processing; this page does not execute unspecified transfer documents.
Requests, deletion, and assistance. ItemFits will reasonably assist the merchant with access, correction, erasure, restriction, and objection requests, taking account of the nature of processing and information available. Shopify privacy notifications and verified support requests are request channels, not a guarantee of instantaneous deletion of every dataset or backup. On termination or a verified instruction, ItemFits will cooperate in returning or deleting the applicable shopper data, subject to legal requirements, and explain any outstanding copies, limitations, or required retention. The merchant's copies and exports remain the merchant's responsibility. Deletion and retention controls must be verified before making representations about a specific deadline.
Information and review. ItemFits will provide information reasonably needed to assess its processing obligations and cooperate on an appropriate review, subject to protection of other merchants' data and service security. If an instruction appears incompatible with applicable data-protection requirements or cannot be fulfilled using the available service controls, ItemFits will inform the merchant so the instruction can be resolved or the affected processing suspended.
Contact. Send merchant data-processing questions, requests for additional contractual terms, or instructions to support@itemfits.com and identify your store domain. Publication of these terms does not represent Shopify approval, a completed privacy audit, or acceptance by all existing merchants.
